These Terms of Use (regulamin) govern your use of the gym-track.io website.
1. Who operates this website
This website, gym-track.io, is provided by Volodymyr Filon, an individual based in Poland ("we", "us"). You can contact us at support@gym-track.io.
These Terms, together with our Privacy Policy, form the terms and conditions ("regulamin") for using this website. By using the site you accept them.
2. What this website offers
The website is the information and marketing surface for the Gymtrack mobile app. It provides product information, a blog, an optional email newsletter, and free tools such as the 1RM calculator.
Most of the website is open to everyone and needs no account. The trainer dashboard at /trainer is the exception: it is a signed-in area for coaches working with Gymtrack app users. It requires an account and a paid subscription, and the sections below set out what that costs and how it works. Using the Gymtrack app itself is governed by its own separate Terms of Use.
3. How old you need to be
You must be at least 16 to create an account with us. In Poland 16 is the age at which a person can consent to their own data being processed, and we do not knowingly create accounts for anyone younger.
We ask you to confirm this when you sign up. If you tell us a child has an account, write to us and we will delete it.
4. Technical requirements
To use the website you need a device with internet access and a current web browser with JavaScript enabled. The free tools run in your browser and require no download.
5. The trainer subscription: what it costs
The trainer dashboard is the one paid thing we sell. The rest of this website, and the Gymtrack app your clients use, are free.
You pay per client seat, per month, in US dollars. The first 5 seats cost $7 each per month; every seat after that costs $5 each per month. You choose how many seats you want, from 1 to 50; above that, contact us and we will agree terms with you.
A launch discount of 20% is running at the moment. Where it applies it is reflected in the price shown to you before you confirm, and in the amount Stripe charges.
Payments are taken by Stripe. We never see or store your card details. The exact amount you will be charged, including any tax that applies where you are, is shown on Stripe's payment page before you confirm, and the price and the date of the first charge are shown on our own page before that.
6. Your free month
A first subscription begins with one month free, for up to 10 client seats. It is available once per trainer.
We take your card details when the free month starts, but nothing is charged during it. The first payment is taken on the day the free month ends. That date is shown next to the button before you confirm, and again in the dashboard while the free month runs.
Cancel before that date and you are charged nothing at all.
7. Renewal, changing seats, and price changes
The subscription renews automatically each month, and the card on file is charged, until you cancel it. There is no minimum term and no notice period.
Adding seats takes effect immediately, and you are charged for the rest of the current month straight away. Removing seats takes effect at the start of your next billing month - you keep, and have already paid for, the seats you have until then.
We may change our prices for valid reasons, such as a change in our own costs or in the law, and a launch discount may end. We will tell you by email at least 30 days before any change affects what you pay, so you can cancel first if you would rather not continue.
8. Cancelling
You can cancel at any time from the Billing page in the trainer dashboard. You do not need to email us, call anyone, or give a reason.
Cancelling stops the next payment. Your dashboard keeps working normally until the end of the month you have already paid for, and after that becomes read-only: you can still see your clients, templates and notes, but not add to them. Nothing is deleted, and it all works again if you come back.
You can undo a cancellation from the same page at any point before it takes effect.
9. Right of withdrawal
If you subscribe as a consumer, you have 14 days from the day the subscription starts to withdraw from it without giving any reason. Email us at support@gym-track.io - a clear statement that you are withdrawing is enough, and there is no form to fill in.
When you subscribe you ask us to make the dashboard available to you immediately, and we do. If you then withdraw within those 14 days, you pay only a proportionate amount for the period you actually had access to, and we refund the rest. If you are still inside your free month there is nothing to pay and nothing to refund.
Most trainers subscribe for their own coaching business. If that is your case you are acting as a trader rather than a consumer, and this right does not apply to you. Polish law extends some consumer protections to sole traders where the purchase is not of a professional character for them; if you believe that is your situation, tell us and we will consider it.
10. Refunds
Beyond the withdrawal right above, payments already taken are not refunded, because cancelling always leaves you with the access you paid for until the end of that month rather than cutting it short.
That does not affect your rights if the service was faulty, unavailable, or not what we described - in that case tell us and we will put it right or refund you. Any refund goes back to the card you paid with.
11. Acceptable use
You agree to use the website lawfully and not to supply any unlawful content, attempt to disrupt or overload it, scrape it at scale, or circumvent its security.
You must not use the site in any way that infringes the rights of others or violates applicable law.
13. Free tools
Tools such as the 1RM calculator provide estimates for general informational purposes only. They are not medical, health, or professional training advice, and results are not guaranteed. Always use your own judgement and consult a qualified professional before acting on them.
14. Intellectual property
The website’s content, design, text, logos, and software are owned by us or our licensors and are protected by law. You may view and share links to the content, but you may not copy, modify, or redistribute it commercially without our written permission.
15. Availability and disclaimers
The website is provided on an "as is" and "as available" basis. We do not guarantee it will be uninterrupted or error-free, and we may change or discontinue parts of it at any time.
16. Our liability
To the maximum extent permitted by applicable law, we are not liable for indirect or consequential loss arising from your use of the website.
Nothing in these Terms excludes or limits our liability where it cannot be excluded by law - including liability for death or personal injury caused by our negligence, for intentional damage, or for gross negligence - and nothing affects the mandatory rights you have as a consumer.
17. Complaints
If something is wrong, please tell us at support@gym-track.io. Describe the issue and how we can reach you. We will consider your complaint and respond without undue delay, normally within 14 days.
18. Using and leaving the site
You may stop using the website at any time. We may restrict or suspend access for anyone who breaches these Terms or applicable law, giving notice where reasonable and proportionate.
19. Governing law and disputes
These Terms are governed by the law of Poland. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, and you keep the right to bring proceedings in the courts of your own country of residence where the law allows.
We are not obliged to use, and do not commit in advance to, any out-of-court dispute-resolution scheme. Consumers in Poland may nonetheless seek help from the Trade Inspection (Inspekcja Handlowa) or the Office of Competition and Consumer Protection (UOKiK, uokik.gov.pl); consumers elsewhere in the EU may contact their European Consumer Centre.
20. Changes to these Terms
We may update these Terms for valid reasons, such as changes to the website or the law. We will post the updated version with a new date; continued use after that means you accept the change.
